HB1241 — Mitigating Factors and Sentencing Under 21
House Bill 1241 proposes two changes. First, HB1241 expands the requirement to consider specific mitigating factors at sentencing. Currently these factors need to be considered when sentencing people who committed a crime when under the age of 18. HB1241 increases the age to people under 21.
The other proposed change allows judges to impose a sentence below the mandatory minimum term of incarceration for eligible people who are being sentenced for an offense committed when they were under 21.
