This meeting will focus on how issues around mental illness, trauma and substance use disorders should be handled in the context of a resentencing process. We have another excellent panel that will set the stage for us. For purposes of this discussion, we will focus on the information that is likely to be available when the motions are filed, not the evidence presented at the original sentencing hearing, which may or may not be accessible to the court given the passage of time.

We are also providing a draft of principles we suggest to guide the development of our recommendations. These are primarily based on the American Law Institute’s principles, which are attached, with some modifications to accommodate our discussions to date and Illinois specific factors. We also considered the suggestions we received from the collaborative of advocacy organizations earlier in the year, also attached to this email. We will be collecting your feedback, making revisions and then presenting a final draft for member approval at a future meeting.
